Part A: Terms & Conditions
1. Introduction and Acceptance
These Terms & Conditions ("Terms") govern access to and use of the DC Tech online learning platform and courses (the "Platform", "Services") operated by DC Tech ("Company", "we", "us", "our"), a company incorporated in India with its registered office at [registered address], CIN [CIN number], GSTIN [GSTIN number].
By creating an account, purchasing a course, or otherwise using the Platform, you ("Learner", "User", "you") agree to be bound by these Terms and by our Refund Policy (Part B below), Privacy Policy, and any course-specific terms notified at the point of purchase. If you do not agree, do not use the Platform.
2. Definitions
- "Course" means any online training program, module, certification track, or content made available for purchase on the Platform.
- "Content" means videos, text, assessments, downloadable material, certificates and any other material made available through a Course.
- "Payment Gateway" means the third-party payment processor (currently Razorpay) used to process payments.
- "Order" means a confirmed purchase of one or more Courses by a Learner.
3. Eligibility
The Platform is intended for users who are at least 18 years of age, or who are using the Platform under the supervision of a parent/guardian or through an authorized institutional/corporate account. By using the Platform you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract in your country of residence.
4. Account Registration and Security
- You must provide accurate, current and complete information when registering.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- DC Tech may suspend or terminate accounts found to be shared, resold, or used fraudulently.
5. Courses, Content and Access
Course access is granted for the duration specified on the Course page at the time of purchase (e.g., a fixed access period or lifetime access, as stated per Course). DC Tech may update, modify, or improve Course content from time to time; material changes to a purchased Course's core curriculum will be communicated to enrolled Learners.
Access is for the personal, non-commercial use of the registered Learner only, unless a separate institutional/corporate license has been agreed in writing.
6. Fees, Payments and Taxes
- All prices are displayed in the currency shown at checkout (e.g., INR for India, and USD/GBP/AED or local equivalents for international Learners, subject to gateway support).
- Payments are processed through Razorpay (and/or other authorized payment partners). DC Tech does not store full card or bank credentials; these are handled by the Payment Gateway under its own security and privacy terms.
- Prices are exclusive/inclusive of applicable taxes as indicated at checkout, including but not limited to Goods and Services Tax (GST), Value Added Tax (VAT), and any applicable sales/use tax.
- An invoice/receipt will be issued electronically for every successful payment.
7. Refunds and Cancellations
Refunds and cancellations are governed by the Refund Policy set out in Part B of this document, which forms an integral part of these Terms.
8. Intellectual Property Rights
All Course Content, trademarks, logos, course design, video, text and assessments made available on the Platform are the property of DC Tech or its licensors and are protected under applicable intellectual property laws. No part of the Content may be copied, reproduced, distributed, publicly performed, or used to create derivative works without prior written consent.
9. License Grant and Restrictions
Subject to full payment and compliance with these Terms, DC Tech grants you a limited or unlimited as stated at checkout, non-transferable, revocable license to access and view purchased Course Content for personal learning purposes only. You may not download (except where an explicit download feature is provided), record, resell, sublicense, publicly share, or use Content for training any third party or any automated system, including artificial intelligence or machine learning models.
10. User Conduct and Prohibited Uses
- Do not share login credentials or Course access with unauthorized persons.
- Do not attempt to reverse-engineer, scrape, or circumvent access or Digital Rights Management controls.
- Do not upload unlawful, infringing, or harmful content to any interactive feature of the Platform.
- Do not use the Platform in violation of applicable export-control or sanctions laws.
11. Certificates and Completion
Where a Course offers a certificate of completion, the certificate is issued only upon meeting the stated completion criteria (e.g., minimum attendance, assessment scores). Certificates are for informational/professional-development purposes and do not constitute an accredited degree or diploma unless expressly stated.
12. Third-Party Payment Processing
Payments are processed by Razorpay Software Private Limited and/or other payment partners DC Tech may engage. Use of the Payment Gateway is subject to its own terms of service and privacy policy. DC Tech is not responsible for outages, delays, or errors caused by the Payment Gateway or Learner's bank/card issuer.
13. Disclaimer of Warranties
The Platform and Content are provided "as is" and "as available". DC Tech does not warrant that the Platform will be uninterrupted or error-free, or that completion of a Course will guarantee any specific career, employment, certification, or income outcome.
14. Limitation of Liability
To the maximum extent permitted by applicable law, DC Tech's aggregate liability arising out of or relating to these Terms or the Services shall not exceed the amount actually paid by the Learner for the Course giving rise to the claim in the twelve (12) months preceding the claim. DC Tech shall not be liable for indirect, incidental, special, or consequential damages.
15. Indemnification
You agree to indemnify and hold harmless DC Tech, its directors, employees and affiliates from claims arising out of your breach of these Terms or misuse of the Platform, to the extent permitted by applicable law.
16. Privacy and Data Protection
Personal data is collected and processed in accordance with our Privacy Policy [link], and, where applicable, in compliance with applicable US state privacy laws (e.g., CCPA/CPRA), the UK/EU GDPR framework for UK and EU-based Learners, India's Digital Personal Data Protection Act, 2023, and UAE data protection law for Middle East Learners.
17. Region-Specific Terms
Where these Terms conflict with mandatory consumer-protection law of a Learner's home jurisdiction, the mandatory local law provision will prevail solely to the extent required, and only for Learners resident in that jurisdiction:
- United States: State consumer-protection statutes and FTC guidance on distance selling and negative-option/subscription disclosures (if applicable) apply.
- European Union: EU consumer-protection law, including Directive 2011/83/EU on consumer rights and applicable member-state implementing legislation, governs distance-selling disclosures and withdrawal rights for EU-resident Learners.
- United Kingdom: The Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 grant a statutory 14-day cancellation right for digital content/services purchased at a distance, subject to the exceptions described in the Refund Policy.
- Australia: The Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010) applies to Learners resident in Australia, including non-excludable consumer guarantees (e.g., acceptable quality, fitness for purpose) for online educational services.
- India: Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 apply, including the requirement to display a Grievance Officer's details (see Section 22).
- Middle East / GCC: Local consumer protection regulations (e.g., UAE Federal Law No. 15 of 2020 on Consumer Protection) apply to Learners resident in the relevant GCC state.
18. Term and Termination
These Terms remain in effect for as long as you maintain an account or hold access to a Course. DC Tech may suspend or terminate access for breach of these Terms, with notice where reasonably practicable, without prejudice to any refund entitlement already accrued under Part B.
19. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the United Arab Emirates (UAE). Subject to Section 17, any dispute shall be subject to the exclusive jurisdiction of the courts at [City], UAE, or resolved by arbitration under the Arbitration and Conciliation Act, 1996 seated at [City], as the Company may elect.
20. Force Majeure
DC Tech shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to internet or hosting outages, natural disasters, or governmental action.
21. Amendments to These Terms
DC Tech may update these Terms from time to time. Material changes will be notified via the Platform or by email at least [X] days before taking effect. Continued use after the effective date constitutes acceptance.
22. Notices and Grievance Redressal
In accordance with applicable UAE law, grievances may be addressed to:
- Grievance Officer: [Name]
- Email: [grievance email]
- Address: [registered address]
- Response timeline: acknowledgement within 48 hours, resolution within 30 days, as mandated.
23. Miscellaneous
- Severability: if any provision is held invalid, the remaining provisions continue in force.
- Entire Agreement: these Terms, the Refund Policy and the Privacy Policy constitute the entire agreement between you and DC Tech regarding the Platform.
- Assignment: DC Tech may assign these Terms in connection with a merger, acquisition, or sale of assets.
- No Waiver: failure to enforce a provision is not a waiver of that provision.
24. Contact Information
For questions about these Terms, contact: [support email] | [support phone] | DC Tech, [registered address].
Part B: Refund Policy
1. Overview
This Refund Policy applies to all Course purchases made on the DC Tech platform, regardless of the Learner's country of residence, and should be read together with Part A (Terms & Conditions). Where a Learner's local consumer-protection law grants stronger refund rights than stated below, the local mandatory right applies to that Learner only, per Section 17 of Part A.
2. Standard Refund Window
Learners may request a full refund within [7 / 14] calendar days of the date of purchase, provided that:
- Course content consumed/viewed is below [X]% of total Course duration; and
- No certificate of completion has been issued for the Course; and
- The refund request is raised through the process in Section 5 below.
3. Non-Refundable Situations
- Requests raised after the applicable refund window has lapsed.
- Courses where a certificate of completion has already been issued.
- Courses explicitly marked "non-refundable" at the point of purchase (e.g., heavily discounted bundles, live cohort programs after the cohort start date, or 1:1 mentorship slots already scheduled).
- Third-party or partner-institution courses where the refund terms of that partner apply instead (to be flagged clearly at checkout).
- Cases of suspected fraud, account-sharing, or Terms violation.
4. Region-Specific Refund Rights
- United States: No federal mandatory cooling-off period generally applies to online course purchases; the Section 2 window applies as DC Tech's contractual policy, subject to any stricter state-level rule.
- European Union: EU-resident Learners ordinarily have a 14-day right of withdrawal from a distance contract for digital content under Directive 2011/83/EU, which may be lost once performance has begun with the Learner's prior express consent and acknowledgment of loss of the right.
- United Kingdom: Under the Consumer Contracts Regulations 2013, UK consumers ordinarily have a 14-day right to cancel a distance contract for digital content. This right may be lost once the Learner has started accessing the Course content, but only if DC Tech has obtained the Learner's explicit prior consent to immediate access and acknowledgement that the cancellation right will be lost (this consent must be captured at checkout).
- Australia: Refunds follow Section 2 above; Australian Learners are also entitled to remedies under the Australian Consumer Law (ACL) where the Course does not meet consumer guarantees (e.g., acceptable quality, fit for purpose), which cannot be excluded.
- India: Refunds are processed in line with Section 2 above; Indian consumer law does not mandate a specific cooling-off period for digital services but requires refund terms to be clearly disclosed before purchase, which this Policy satisfies.
- Middle East / GCC: Refunds follow Section 2 above, subject to any stricter mandatory provision under local consumer-protection law applicable to the Learner's country of residence.
5. How to Request a Refund
- Email [refund request email] with your registered email address, Order ID, and reason for the request; or
- Raise a request through the "My Orders" section of the Platform (if available).
- DC Tech will acknowledge the request within [2] business days.
6. Refund Processing Time and Method
Approved refunds are processed to the original payment method via Razorpay. Processing times are per the payment gateway system used. DC Tech does not process refunds in cash or to a different account/card than the original payment method, except where required by law.
7. Partial Refunds
At DC Tech's discretion, a prorated partial refund may be offered where a Learner has consumed part of a Course but the request falls outside the standard full-refund window, or for bundled purchases where only some Courses in the bundle are being refunded.
8. Failed, Duplicate, or Erroneous Payments
Where a payment fails to reflect enrollment, or a Learner is charged twice for the same Order due to a gateway or technical error, the duplicate/failed amount will be refunded by the payment gateway per their refund policy terms and conditions.
9. Chargebacks and Payment Disputes
Learners are encouraged to contact DC Tech support before initiating a chargeback with their bank or card issuer. DC Tech reserves the right to suspend Platform access during an open chargeback investigation and to present evidence of Course access/usage to the Payment Gateway or card network as part of the dispute process.
10. Changes to This Policy
DC Tech may revise this Refund Policy from time to time. The version in effect at the time of a Learner's purchase will govern that purchase, unless a change is required by law to apply retroactively.
